General Terms and Conditions for Vehicle Rental

For the rental agreement concluded between:

Kymove Rentals SL, Carrer Cervantes, 7, 07458 Can Picafort, Balearic Islands (hereinafter referred to as the Lessor) and the customer (hereinafter referred to as the Lessee), the following terms and conditions apply:

1. Minimum age and driving license requirements

125 cc Scooter

  1. Minimum age: 18 years
  2. Valid driving licenses: A1 / A2 / A / B

Category B license: minimum age 21 years with at least 3 years of driving experience.

2. Subject matter of the contract

2.1 The subject of the contract is exclusively the temporary rental of the reserved vehicle and/or its accessories.

2.2 All prices include third-party liability insurance. Fuel costs are not included.

2.3 A security deposit of €200 is required by credit card (VISA/Mastercard) or cash prior to vehicle delivery.

2.4 Fuel policy: full upon pick-up / full upon return.

If the vehicle is returned without a full tank, the following will be charged:

  1. €3 per missing litre
  2. €10 service fee

3. Payment

The full rental amount, as well as the deposit, must be paid in full before the start of the rental period.

Any damage, excess rental time, or missing fuel will be deducted from the deposit or charged afterwards.

The Lessee agrees to immediately pay any amount exceeding the deposit.

4. Obligations of the Lessee

4.1 The Lessee agrees to use the vehicle with due care, complying with technical instructions, operating guidelines, and all applicable Spanish traffic regulations.

The Lessee must regularly check oil levels, coolant levels, and tyre pressure.

The Lessee is responsible for any fines, penalties, or administrative charges arising from the use of the vehicle.

4.2 The following is strictly prohibited:

a) Allowing the vehicle to be driven by unauthorized third parties not listed in the contract.

b) Allowing driving by persons without a valid license or under a driving ban.

c) Driving under a driving ban or without a valid license.

d) Using the vehicle in an unfit condition for driving.

e) Participation in motor sports events or competitions.

f) Driving off paved roads or on beaches.

g) Tampering with the odometer (any malfunction must be reported immediately).

h) Selling, pledging, or disposing of the vehicle or its parts.

i) Failing to properly secure the vehicle against theft.

j) Taking the vehicle the island of Mallorca.

5. Obligations of the Lessor

The Lessor delivers the vehicle in perfect condition, clean, and roadworthy, together with its documents and accessories.

Pre-existing damages will only be acknowledged if recorded in writing in the rental contract at the time of delivery and signed by both parties.

Tyre damage is always the responsibility of the Lessee.

6. Liability of the Lessee for damages

From handover until return, the Lessee is liable for any damage caused by slight negligence or improper use, including loss or confiscation of the vehicle or its parts.

In case of damage, the Lessee shall cover:

  1. Repair costs
  2. Recovery and transport costs
  3. Expert appraisal costs
  4. Loss of value of the vehicle
  5. Loss of rental income during repair or replacement

The Lessee is also responsible for rented accessories (helmets, keys, documents, etc.).

7. Accident and procedure

In the event of an accident or damage:

  1. The Lessee must immediately inform the Lessor by phone.
  2. No towing or repairs may be arranged without prior authorization.
  3. In case of third-party involvement, the police must be called.
  4. Evidence and details of all parties must be collected.
  5. It is prohibited to admit liability or make agreements without consent from the Lessor or insurer.

8. Insurance and deposit

a) The vehicle is covered by mandatory third-party liability insurance.

b) A €200 deposit is required and will be refunded if the vehicle is returned without damage.

The deposit may be withheld until final damage assessment is completed.

The Lessee is also liable in the following cases:

  1. Breach of Section 4
  2. Leaving the scene of an accident
  3. Damage caused by gross negligence or intent
  4. Unauthorized extension of the rental period

9. Delivery and return

The vehicle is delivered clean, with a full tank and no visible damage.

It must be returned:

  1. With a full tank
  2. On the agreed date, time, and location
  3. With keys, documents, and accessories in proper condition

Any missing item will be charged in full.

In case of excessive dirt, cleaning fees will apply.

Delays:

· 10% of rental time: one additional day charged

· 50%: double rental period charged

· 100% without notice: considered misappropriation and legal action will be taken

The Lessor may terminate the contract immediately in case of serious breach or false information.

10. Cancellations

  1. More than 25 days before: no charge
  2. 25 to 15 days: 30%
  3. 14 to 8 days: 50%
  4. 7 to 1 day: 80%
  5. No-show: 100%

11. Final provisions

No additional agreements exist outside this contract. Any changes must be made in writing.

If any clause is found invalid, the remaining provisions shall remain unaffected (severability clause).

11.1 Governing law and jurisdiction

This agreement is governed by Spanish law, excluding conflict-of-law rules.

Exclusive jurisdiction lies with Palma de Mallorca, Spain.
